Release of Liability
In exchange for participation in the NEO (Natural Energy Optimization) session offered by The Well Frequency, LLC located at 1061 N. Coleman St. Suite 100, Prosper, TX 75078. I hereby agree on my own behalf and on behalf of all of my heirs, assigns and successors, as follows:
COMPLIANCE WITH POLICIES.
I agree to comply with all posted rules, policies, warnings, and other instructions, oral or written, offered by The Well Frequency or its staff, employees, representatives or agents.
ASSUMPTION OF RISK AND RELEASE OF LIABILITY.
I understand and accept that: 1) the Treatment affects each person differently; 2) The Well Frequency, LLC does not promise any particular result from participating in the Treatment; and 3) The Well Frequency, LLC cannot guarantee me that I will not experience any side effects from the Treatment. I expressly acknowledge that the Treatment may not provide me with any benefit whatsoever, and that no particular benefit has been promised me. Further, I assume full responsibility for any illness or injury of any kind that I may suffer as a result of my presence on The Well Frequency’s premises and/or the Treatment, and I release and discharge The Well Frequency, LLC from liability for any illness, injury, loss or damage
arising out of my use of or presence upon The Well Frequency, LLC’s premises, whether caused by the Treatment, myself, or other third parties.I understand and agree that the fee I am paying is for an opportunity to
experience the Treatment and not for any other purpose.
INDEMNIFICATION.
I agree to indemnify and hold The Well Frequency, LLC harmless against all third-party claims, causes of action, damages, judgments, costs, or expenses, including without limitation attorney fees or other court costs, arising out of or relating to my presence on The Well Frequency, LLC’s premises.
MISCELLANEOUS.
The validity of this agreement, its construction, interpretation, and enforcement, and the rights of the parties hereunder shall be determined under, governed by, and construed in accordance with the laws of the State of Texas. The parties agree that all actions or proceedings arising in connection with this Agreement shall be tried and litigated only in the state and federal courts located in Collin and/or Denton County, State of Texas. The invalidity or unenforceability of any provision contained in this Agreement shall not affect the enforceability of any other provision of this Agreement. Such invalid or unenforceable provision shall be deemed revised, to the extent possible, only as necessary to make any such provision enforceable in accordance with the terms of this Agreement.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SELECTING THIS BUTTON, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS. I ACKNOWLEDGE THAT THE WELL FREQUENCY, LLC IS RELYING ON THE PROMISES I HAVE MADE IN THIS AGREEMENT IN ORDER TO ALLOW ME TO EXPERIENCE THE NEO SESSION AND, IF I REFUSE TO CONSENT TO THIS AGREEMENT, I WILL NOT BE ALLOWED TO EXPERIENCE THE TREATMENT.
